Abstract
Through its principle of progressive liberalization, GATS requires member countries to gradually reduce or even eliminate all barriers that are not important in trade in services including higher education. The liberization of higher education will cause at least two problems. The first problem is the ability of Indonesian higher education institutions with foreign higher education, while the second is legal issues. Regarding legal issues, Indonesia as a sovereign country, the government is obliged to carry out the mandate of the constitution and laws and regulations, namely treating education as a public service. Then on the other hand, Indonesia also participates in international trade institutions. Based on this presentation, two main problems arise that need to be examined, the first is related to the implications of GATS on the liberalization of higher education in Indonesia. While the second is how ideal the regulations related to foreign universities in Indonesia. In this study, I used normative legal research methods. The normative legal research method is legal research conducted by examining library materials or secondary data, consisting of primary, secondary and tertiary legal materials. In this research I use legal principles, and use a legal approach. The data obtained are analyzed qualitatively and conclusions are drawn by deductive methods. The results of the research obtained are that the implications of GATS on the liberalization of higher education in Indonesia can be divided into two parts, namely positive and negative implications. The positive implication is that every community will have the freedom to choose quality universities, both local and foreign. While the negative implication is that universities, which were originally noble places, slowly became centers of profit-oriented science.
