Abstract
Marriage within the same tribe or clan is one of the traditions that is still maintained by the people of Pulau Birandang Village, Kampa District, Kampar Regency. However, this tradition has been banned by the local community because it is considered inconsistent with modern values and human rights. The ban on marriage within the same tribe for the indigenous people of Pulau Birandang Village, Kampa District, Kampar Regency is because the indigenous people view that the relationship within the same tribe is a family relationship because the indigenous people of Pulau Birandang Village, Kampa District, Kampar Regency still believe that people who are born in the same tribe are blood relatives and marriage within the same tribe or clan is a hereditary tradition for the Kampar community. The problem of this research is what are the factors causing the prohibition of inter-tribal marriage in Pulau Birandang Village, Kampa District, Kampar Regency and what are the customary sanctions against inter-tribal marriage in Pulau Birandang Village, Kampa District, Kampar Regency. This study uses an empirical legal approach with primary data obtained through interviews and observations, as well as secondary data from related legal documents, then data analysis is carried out qualitatively. Data were obtained from research respondents using data collection tools in the form of interviews about the prohibition of inter-ethnic marriage in Pulau Birandang Village, Kampa District, Kampar Regency. From the results of the study it was found that how the implementation of the prohibition on inter-tribal marriage in Pulau Birandang Village, Kampa District, Kampar Regency, namely the imbalance of power, weak law enforcement, differences of opinion in society, limited knowledge, sanctions applied, migration and social change because if there are still those who carry out inter-tribal marriages, they will receive sanctions in the form of being ostracized by the village community, paying a fine of one buffalo, losing customary rights and bringing negative impacts or disasters to the family and local community.
