Abstract

A sale and purchase agreement is an agreement created and executed by parties called the seller and the buyer. In the agreement, each party has a right and obligation in the agreement. Causes of default Negligence, breaking promises, not carrying out obligations according to the agreement, doing things that are prohibited in the agreement, being late in fulfilling promises. The formulation of the problem taken from this thesis research is first how the implementation of buying and selling bricks between brick sellers and brick buyers in Tenayan Raya Subdistrict, Pekanbaru City, second how the legal analysis of default in the brick sale and purchase agreement in Tenayan Raya Subdistrict, Pekanbaru City. The research method in this thesis the author uses the type of sociological research or empirical law used in observational research, namely by plunging into the field to obtain a number of data using observation, interviews and documentation. The data sources used in the research the author uses are primary data and secondary data. And the nature of the research is descriptive analysis, namely the author describes a problem by revealing the facts as complete as possible and what they are. The conclusion research method that the author uses in this research is the inductive method, which is a method of thinking that starts from specific things towards general matters. From the results of research and discussion that the author found, namely as follows: First, that the implementation of buying and selling bricks between brick sellers and brick buyers in Tenayan Raya District, Pekanbaru City, the existence of the brick industry has had a positive impact on the community because it provides employment. Second, the legal analysis of default in the brick sale and purchase agreement in the Tenayan Raya sub-district of Pekanbaru city is not carried out in accordance with the regulations of the Law, where the agreement should be created to be obeyed so that no violations occur in people's lives, and the obstacle in this agreement is that oral or unwritten agreements are very vulnerable to fraud by the parties which will create default or broken promises, where one of the parties will be able to not keep or not carry out its obligations in accordance with the contents of the agreement.
