Abstract
Consumer protection is all efforts to guarantee consumer rights in goods purchase transactions. Article 2 of the Consumer Protection Law (UUPK) states that "consumer protection is based on benefits, justice, balance and consumer safety and legal certainty". Tiktok Shop is currently a trend among the public. Because the prices of goods on Tiktok Shop are much more affordable than other e-commerce. Apart from that, there are very varied payment methods, namely bank transfer or Cash On Delivery (COD). One payment method that is very popular among the public is Cash On Delivery (COD). This thesis research has two problem formulations, namely: first, what form of legal protection is given to consumers who experience damage to goods ordered by Cash On Delivery (COD) via the Tiktok Shop application and secondly, what is the dispute resolution mechanism provided to consumers who experience damage to goods ordered by Cash On Delivery (COD) via the Tiktok Shop application. This type of thesis research uses empirical legal research (observational research), namely using survey data collection tools, namely by going to the field to obtain materials. So this research was carried out directly at the location. The nature of this research is descriptive analysis, meaning that this research provides an overview and examines and analyzes a complete, detailed and clear statement regarding Consumer Protection against Damage to COD (Cash On Delivery) Goods ordered via the Tiktok Shop Application (e-commerce) reviewed in the Law of the Republic of Indonesia Number 8 of 1999 concerning Consumer Protection in Pekanbaru. The method for formulating research results that the author obtained is that legal protection for consumers in online buying and selling transactions via TikTok Shop has not been implemented optimally as in the Consumer Protection Law (UUPK). Business actors violate provisions regarding consumer rights to safety and security but consumers who suffer losses do not receive consumer compensation as regulated in Article 4 letter h of the Consumer Protection Law (UUPK) which states the right to receive compensation, compensation and/or replacement, if the goods and/or services received are not in accordance with the agreement or are not as they should be. This is because consumers lack knowledge, business actors are irresponsible, and there is minimal supervision from the government. So based on this research it can be concluded that legal protection cannot be obtained.
