Abstract

Marriage is a sacred part of life, because it must pay attention to the norms and rules of life in society. With various justifications, marriages are carried out through various models such as running away marriages, contract marriages to marriages that are popular in society, namely unregistered marriages. Unregistered marriages are known by other terms such as 'underhand marriages' or religious marriages, namely marriages that are carried out based on religious rules or customs and are not registered at the marriage registrar's office (KUA). The formulation of the problem in this study is: First, What are the legal consequences of unregistered marriages on the position of wives, children, and their assets in Kubu Babussalam District, Rokan Hilir Regency? Second, What are the factors causing unregistered marriages in Kubu Babussalam District, Rokan Hilir Regency? In this study, the author used a type of sociological legal research or empirical law (Observational Research) namely by going into the field to obtain a number of data. The data and data sources that the author uses are secondary data. The data collection techniques that the author uses are observation, interview, and documentation techniques. Meanwhile, the method of drawing conclusions that the author uses in this study is the deductive method, namely taking conclusions from general to specific things. From the results of the research and discussion that the author found, namely: First, the legal consequences of unregistered marriages on the position of wives, children, and their assets in Kubu Babussalam District, Rokan Hilir. Unregistered marriages have many negative impacts on wives, children, and their assets, these negative impacts are the legal power to recognize as a legitimate wife and child does not exist, demanding rights as a wife and child cannot be because there is no evidence in the form of state documents, wives and children are not entitled to maintenance from their husbands, wives and children are not entitled to joint property, children who are born only have a civil relationship with their mothers while the relationship with their father is not strong. Second, the factors that cause unregistered marriages are: not being old enough and getting pregnant outside of marriage, the desire to practice polygamy, couples do not know and do not want to know about legal procedures, economic factors, namely the inability of the community to pay for costs and take care of complicated administrative requirements.
