Abstract

Regulations regarding work agreements have been regulated in the Job Creation Law as well as Government Regulation Number 35 of 2021 concerning Work Agreements for Specific Periods, Outsourcing, Working Time and Break Time and Termination of Employment. One form of work agreement is a Specific Time Work Agreement, PT. Garda Bersatu Nusantara is a service provider company which employs workers with specific time work agreements engaged in the employment sector. The problem that often occurs is that the contents of the work agreement are not in accordance with the laws and regulations so that it is detrimental to workers. This happened to workers at PT. Garda Bersatu Nusantara. In this study, the authors raised the problem that was used as research material, namely how to implement the working relationship between security service business entities and outsourced workers and how the remuneration system for outsourced workers in security service business entity companies. Based on the type of this research, namely observational research which was carried out by means of a survey, the author went straight to the field to obtain and collect the data through interviews. The nature of the research is descriptive in nature, namely providing information that explains in detail regarding the Protection of Outsourced Workers in Security Service Companies (Studies at PT.Garda Bersatu Nusantara). The results of the author's research show that the protection of outsourced workers at PT. Garda Bersatu Nusantara still cannot be realized because the work agreement between the company and the workers is not in accordance with applicable laws, such as wages below the UMK, no overtime pay for workers with Fixed Time Work Agreements. This is due to the inefficiency of supervision carried out by the Department of Manpower and Transmigration resulting in many outsourcing companies violating laws and regulations.
