Abstract

The growing era has also led to increasingly sophisticated technology, one of which is mobile phones. Mobile phones are one of the human needs in communicating and adding knowledge. Many brands of mobile phones exist in Indonesia with different prices and qualities. The lack of understanding of consumers in buying mobile phones can harm themselves because there are still business actors who are not honest in providing clear information about the condition of the mobile phones they sell. Legal protection of consumers is regulated in Law Number 8 of 1999 concerning Consumer Protection. The formulation of the problems in this study are: First, How is the legal protection of consumers in the purchase of used mobile phones in Pekanbaru Mall. Second, What are the obstacles to legal protection of consumers in Pekanbaru Mall. The type of research used by the author is empirical legal research, which means legal research that examines the law by conceptualising it as real behaviour and social symptoms that are not written and obtained by conducting interviews and direct observations obtained from the field. Data collection that the author uses through questionnaires and interviews. And the method of drawing conclusions that researchers use is the deductive method, namely from general things to specific things. The results of this study indicate that the position of consumers is still weak against legal protection in accordance with Law Number 8 of 1999 concerning Consumer Protection. There are still business actors who override their obligations in running their business. Consumers have the right to obtain clear information about the mobile phones they buy. For losses suffered by consumers, it is the responsibility of the business actors who must comply with the provisions and in accordance with the warranty of the mobile phone purchase.
