Abstract

Starting from the development of the times, there are prohibited acts whose validity is not only maintained by the sovereignty of a country, but also maintained by the international community. These acts are then qualified as international crimes. One of the actions that received the attention of the world and included in the qualifications of international crimes and until now there has been no bright spot from the international court is the attack of the Mavi Marmara ship, which is one of the ships used in the activities of The Gaza Freedom Flotilla, an activity compiled by the Yahdim Vakfi foundation, in order to provide humanitarian assistance to the Palestinian population in the Gaza Strip was attacked by the Israeli military which was resisted by the passengers, after the passengers surrendered the ship and passengers were taken prisoner in Ashdod port by Israel. This thesis aims to determine whether there is a shift in the legal status of the Mavi Marmara ship and its passengers as objects and civilians and the attacks and captivity carried out by Israel contrary to International Criminal Law, especially the Rome Statute 1998. This research uses normative juridical methods. Data processing is done by means of qualitative analysis while drawing conclusions using the inductive logic method. The conclusion of this research is: the passengers of the Mavi Marmara continue to have legal status as civilians as stipulated in the Geneva Convention, and during the attack and captivity carried out by the Israeli side there were violations of the provisions in the Rome Statute 1998.
