Abstract

Consumer protection is one aspect of legal development in Indonesia that is becoming increasingly important today, considering the many cases of consumer rights violations committed by business actors. Buying and selling is the process of exchanging goods that have value in a transaction, one form of buying and selling is buying and selling food. Buying and selling is an activity that is always carried out by the community, but in practice it still causes problems. The problems that still occur are the circulation of expired food which can harm the comfort, security and safety of consumers. Expired food products are products that have passed the expiration date listed or stated on the product packaging label. Therefore, Law Number 8 of 1999 concerning Consumer Protection is present to regulate the implementation of consumer protection in Indonesia, including the rights and obligations of both business actors and consumers. The formulation of the problem in the research above is: first, how is the implementation of Law Number 8 of 1999 concerning consumer protection against expired food products in desa pandau jaya kecamatan siak hulu and second, what is the responsibility of business actors towards consumers who are harmed due to the purchase of expired food products in desa pandau jaya kecamatan siak hulu. The type of research used by the author is a type of sociological legal research, namely field research conducted by going directly to the location using interviews and questionnaires as data collection tools and using a method of drawing conclusions, namely the deductive method, which is the process of drawing conclusions from general things to specific things. From the results of the research and discussion that the researcher found: first, the implementation of legal protection for consumers in desa pandau jaya kecamatan siak hulu, in practice, has not yet run as it should because there are still violations of consumer rights committed by business actors. Second, wholesale and supermarket business actors in desa pandau jaya kecamatan siak hulu already have a sense of absolute responsibility or strict liability.
