Abstract
It cannot be denied that Notaries also make it possible to do things violations of the law whether the Notary does this intentionally or unintentionally. As long as the Notary carries out his duties and positions in accordance with his mandate Notary Position Law and has complied with the procedures for making it an authentic deed then the Notary will not face demands or a lawsuit for a violation of the law that he made. One form of action The crime that often occurs in the notary profession is the crime of forgery authentic deed. The criminal acts that often occur are related to Article 263 Criminal Code (making fake letters or falsifying letters), Article 264 of the Criminal Code (falsifying authentic deeds), and Article 266 of the Criminal Code (ordering to enter false information into an authentic deed). From the background above, the author formulates the main problem including: First, how is law enforcement against notaries Committing the Crime of Forgery of Authentic Deeds in the Legal Area of ??the Police Pekanbaru? Second, what are the obstacles in law enforcement against notaries Those Who Commit the Crime of Forgery of Authentic Deeds in the Legal Area Pekanbaru Police? Judging from its type, this research can be classified to Empirical Sociological research, namely research carried out by survey, namely research directly to the research location using data collection tool in the form of interviews.. Meanwhile, the nature of this research is descriptive, namely providing an overview clear and detailed about the problem at the heart of the research. After through the process of data collection and data processing, then the data is analyzed based on qualitative methods, then after the data is analyzed, it is formulated inductive conclusions, namely drawing conclusions from specific things to the public. From the research results, it can be concluded: First, law enforcement There is no criminal offense of forgery of authentic deeds in the Pekanbaru Police jurisdiction running effectively. One of them is still the fact that differences often occur interpretation between the notary and law enforcement officials, so that in the process The investigation encountered obstacles. Second, influencing factors law enforcement from Law Enforcement Officials faced by Polrestabes Pekanbaru regarding criminal acts of forgery of authentic deeds, including the reporter lack of understanding about authentic deeds, Difficulty in confiscating documents, In this case the Notary, the Notary's honorary council in making decisions does not involve the police, Difficulty in obtaining documentary evidence, Witnesses who have died, request permission to confiscate documents via Difficult BPN Regional Office, and budget limitations.
