Abstract

Children, as the younger generation, play a vital role in society, however, their rights are often overlooked, especially when they engage in deviant behavior. The developmental process of children, which involves physical and psychological changes, requires adequate attention from parents and the surrounding environment. Without sufficient support, children may fall into criminal activities. Therefore, investigators play a crucial role in ensuring that legal processes concerning children’s rights. Investigators must meet specific qualifications and understand child-related issues to perform their duties in a humane manner. This study aims to analyze the implementation of legal protection during the investigation process of theft with aggravating circumstances committed by children at the Indragiri Hilir Police Resort, as well as the obstacles in realizing such legal protection. The research employs a sociological and descriptive approach, with the population consisting of the Head of the Women and Children Service Unit and investigators. Primary data is obtained through observations and interviews, while secondary data is collected from literature and legal regulations. The findings indicate that the legal protection provided is aimed at complying with applicable laws, encompassing humane treatment, separation from adults, and special assistance. However, challenges such as limited facilities, a minimal number of investigators, and a lack of rehabilitation institutions hinder the effectiveness of this protection. To enhance legal protection for children, improvements in facilities, parental support, and the development of more comprehensive rehabilitation programs are necessary.
