Abstract
A house is a basic need that functions for human life. As stated in Article 28H Paragraph (1) of the 1945 Constitution, it states that a house is one of the basic rights of the people, and therefore every citizen has the right to live and have a good and healthy living environment. Because a house is very important, this is utilized well by developers as business actors in the housing sector. In marketing the houses that are built, developers usually market them with three payment methods, namely cash payment, payment through bank facilities (KPR) and cash payments in installments. PT Pendar Hasbu Properti, as one of the developers in the housing sector, offers Bona Persada Residence Housing with a cash payment method in installments. Although this method offers many advantages, there are challenges that must be faced. In order forthe process of buying and selling a house with a cash payment method in installments to run smoothly, an in-depth analysis is needed. The formulation of the problem in this study is how the process of implementing the sale and purchase of a house with a cash payment method in installments at PT. Pendar Hasbu Properti Bona Persada Residence Housing and what factors must be met and avoided so that the house sale and purchase agreement with this cash payment method in installments can be implemented. The method used by the author in this study is empirical legal research, by means of direct surveys in the field. The nature of this research is descriptive analytical which provides an overview and interprets a fact systematically. Data collection tools in this study are interviews, observations, and documentation. The results of this study are the implementation of buying and selling houses in the Bona Persada Residence housing complex with a cash payment method in stages. In its implementation, this process begins with searching and offering after prospective buyers decide to buy a house with a cash payment method in stages. The next step is to prepare a PPJB. The contents of the PPJB are adjusted to the agreement between the two parties. After the payment is paid off, the next step is to make an AJB. Factors that must be met and avoided so that the house sale and purchase agreement with the cash payment method in stages can be implemented properly, which must be met, the price agreement must be clear, the payment method must be regulated in detail, good communication, and involving a notary in making the agreement, factors to avoid, ignoring the examination of ownership documents, not involving a notary, poor communication, and not including a sanction clause.
