Abstract

Land disputes is a problem that often occurs in Indonesia, especially land disputes between companies and communities. Land disputes between companies and communities often occur in Indonesia. In Pinggir Subdistrict, Bengkalis Regency, land disputes often occur between existing companies and the community. The existence of legal certainty regarding the settlement of land settlements between the company and the community in Pinggir District, Bengkalis Regency is very important for the community. With legal certainty, the public will know their rights and obligations according to law. This study aims to analyze land dispute conflicts that occur between companies and communities and how is the principle of legal certainty in resolving land disputes between and the community in Pinggir District, Bengkalis Regency. The method used in this study is a qualitative method by conducting interviews with relevant sources. Based on research conducted, the main cause of the occurrence of disputes is the boundaries of residents' land and company land that are mutually protected. The most common thing that happens is when the community is farming in their customary territory, they often experience clashes with PT. the X. The principle of legal certainty related to land disputes is regulated in the Basic Agrarian Law. Settlement of small-scale land disputes can be resolved by involving the police as a mediator in mediating the settlement of land disputes. This is done using a restorative justice approach
