Abstract
The occurrence of intra-clan marriages in the customary law community in Jake Village, Kuantan Singingi Regency, is based on mutual affection, or what is known as an individual factor. This study explains the implementation of sanctions imposed on those involved in intra-clan marriages and several factors that encourage intra-clan marriages in Jake Village, Kuantan Singingi Regency. The main issue in this research is the application of customary sanctions imposed by customary leaders on members of the customary law community who engage in intra-clan marriages in Jake Village, Kuantan Singingi Regency, as well as the factors behind the occurrence of intra-clan marriages within the customary law community in this area. The method used in this study is empirical legal research, with a literature review approach as supporting data. The data sources used in this research include primary data obtained directly through interviews with selected informants and secondary data from various literature and regulations, with the study being descriptive and analytical in nature. The results of this study indicate that the sanctions imposed on individuals who engage in intra-clan marriages by the customary leaders of the Piliang, Malay, and Patopang clans are as follows: any individual who engages in an intra-clan marriage is excluded from participation in customary interactions and deliberations by the ninik mamak (customary leaders), and is also not included in customary events such as "sehilir semudik" (a traditional ceremony or procession). The final sanction involves a fine, which usually requires the slaughtering of two goats one by the male party and one by the female party. Furthermore, the factors behind intra-clan marriages in Jake Village, Kuantan Singingi Regency, include mutual love (individual factor), knowledge of customary law (education), and the social environment of the community.
