Abstract

Withdrawing or confiscating debtors' motorbikes does not only occur at customers' homes, and debt collectors act as criminals who confiscate debtors' vehicles while they are driving on the street. To provide a deterrent effect against criminals, efforts are made to control criminal acts against the perpetrators, namely by providing criminal sanctions in the form of law enforcement to perpetrators of criminal acts. The main problem in this research is how to enforce the law against debt collectors who seize motorbikes from leasing debtors in the jurisdiction of the Pekanbaru City Police and what obstacles the police face in carrying out law enforcement. The research method uses a normative and empirical juridical approach, the data used is secondary data and primary data for the implementation of the study which was carried out using library research and field studies, the data analysis used by the researcher was qualitative. From the results of the author's research and discussion, it shows that law enforcement against debt collectors who confiscate consumers' vehicles on the road means that the public as debtors can report all forms of criminal acts committed by debt collectors to the police if they feel that the debt collector's actions in collecting debts cause losses to debtors, according to Law Number 2 of 2002 which regulates the National Police of the Republic of Indonesia. The conclusion of this research is that in situations where the police must be more sensitive to prospective and actual community concerns, they must also be actively involved in outreach to the community. which invites the public to take part in helping law enforcers carry out their duties, which are more than just eradicating crime, by offering to be placed as witnesses to avoid obstacles in the investigation process. The criminal acts that can occur include Article 369, Article 378 and Article 335 of the Criminal Code. Supreme Court Decision Number 3192 K/Plt/2012 which harmed Standard Chartered Bank customers because third party services (debt collectors) authorized by the bank did not work professionally and used intimidation and thuggery approaches
