Abstract

This study examines the legal protection for consumers against hidden defects in the transaction of buying and selling used clothes at Sobat Thrift Pekanbaru. Law Number 8 of 1999 concerning Consumer Protection Article 8 Paragraph 2 states that business actors are prohibited from trading damaged, defective or used, and contaminated goods without providing complete and correct information about the goods in question, However, used clothing business actors in Sobat Thrift Pekanbaru do not have a sense of responsibility for compensation and/or compensation for consumers who experience hidden defects that should be the consumer's right. The main problems raised by the author in this study are first, how to protect consumers from hidden defects in used clothing buying and selling transactions at Sobat Thrift Pekanbaru. Second, what are the obstacles in obtaining legal protection for consumers for hidden defects in buying and selling transactions at Sobat Thrift pekanbaru. In this study, the author uses a type of observational research method by conducting interviews with used clothing business actors of Sobat Thrift Pekanbaru. The result of this study is that second-hand clothing business actors are not responsible for used clothes that have hidden defects in them. Business actors refuse to pay compensation or compensation that should be the right of consumers as stipulated in the Civil Code and Law Number 8 of 1999 concerning Consumer Protection. Meanwhile, the obstacle to getting legal protection for consumers for hidden defects in used clothing transactions at Sobat Thrift Pekanbaru is that consumers and business actors lack understanding and lack of knowledge of their respective rights and obligations as regulated by law. No doubt, business actors argue that the goods that have been purchased cannot be returned because it is no longer the responsibility of the store even though there was no agreement on this matter before. This is of course contrary to Law Number 8 of 1999 concerning Consumer Protection.
