Abstract
A Village-Owned Enterprise (BUMDes) is a community-based entity designed to manage village resources by delegating specific responsibilities to its members. This research examines the practice of savings and loan agreements facilitated by BUMDes in Kebun Durian Village, located in Gunung Sahilan District, Kampar Regency. The savings and loan agreements serve as a collaborative effort between BUMDes and the local community, aiming to enhance the economic prosperity of the village. The primary objective of this study is to evaluate the agreement mechanisms, identify the involved stakeholders, and address the challenges faced during the implementation process. The core question explored in this study is how the agreements are carried out and how potential conflicts between BUMDes and customers in Kebun Durian Village, Gunung Sahilan District, Kampar Regency, are managed and resolved. The methodology applied combines normative legal analysis with empirical research, involving a review of legal frameworks and insights gathered from the community. Data collection methods include structured interviews, documentation reviews, and the use of questionnaires directed at relevant stakeholders. The results reveal that the savings and loan agreements between BUMDes and customers in Kebun Durian Village are formalized through written contracts, specifically documented in the Credit Agreement Letter (SP2K). These agreements outline the respective rights and responsibilities of the parties, such as repayment schedules, deadlines, penalties for overdue payments, and measures taken against customers who fail to meet their financial obligations. Dispute resolution efforts between BUMDes and customers prioritize a non-litigation approach as the primary method for resolving conflicts. This non-litigation resolution is carried out by visiting the customer’s residence, identifying their financial difficulties, and offering solutions to help them fulfill their obligations. Additionally, creditors issue warning letters in stages to remind customers of overdue payments. The nonlitigation approach is preferred because it is more efficient, does not incur additional costs, and aligns with the strong family-oriented values upheld by BUMDes in Kebun Durian Village. Through this method, disputes can be resolved through deliberation and consensus without the need for lengthy and complex legal proceedings.
