Abstract

One of the problems often faced by consumers is the circulation of expired food, which of course can endanger consumer health. In Payung Sekaki District, there are several Supermarkets that sell various food products, including food that has passed its expiration date. This incident not only harms consumers in terms of health, but also has the potential to reduce consumer trust in business actors. The main problem in this study is legal protection for consumers for the circulation of expired food in Supermarkets in Payung Sekaki District based on Law Number 8 of 1999 concerning consumer protection and the responsibility of business actors towards consumers who consume expired food in Supermarkets in Payung Sekaki District. The method used in this study is empirical legal research and a literature analysis approach as supporting data. The data sources used in this study are primary data obtained directly from interviews with predetermined sources and secondary data sources obtained from various literature and Laws and Regulations, and the nature of this study is descriptive analysis. Based on the research results, it can be understood that legal protection for consumers regarding the circulation of expired food in supermarkets in Payung Sekaki District is regulated by Law Number 8 of 1999, originating from BPOM, consumers and business actors. In this case, business actors have an obligation to guarantee the safety of the products sold. Consumers have the right to obtain safe products and clear information regarding the expiration date, and are entitled to compensation or a refund if they buy expired products. So that the role of strict BPOM supervision of business actors who violate this provision is needed to protect consumer rights. Meanwhile, the responsibility of business actors towards consumers who consume expired food in supermarkets in Payung Sekaki District includes the obligation to ensure that the products sold are safe and in accordance with applicable provisions, including not selling expired food. This responsibility shows the need for business actors to maintain the quality and safety of the products sold in order to protect consumers.
