Abstract

Marriage is an important issue in determining the status of children's inheritance rights. Although there are many types of marriage, the status of the child's inheritance rights in each child of each of the marriages is different. This study aims to find out how the status of children's inheritance rights in marriage sirri and after the marriage is isbat right. This study uses a qualitative analysis approach with 3 respondents who provide information related to the data needed. In-depth interviews were conducted with 3 Heads of KUA in Pekanbaru to obtain information. The collected data will be selected, grouped, and processed based on their type, then presented with clear and detailed sentence descriptions. The results of the study show that every child born will have inheritance rights from their mother. To determine whether the child gets an inheritance from his father, it is necessary to look at the marriage carried out by both parents. The child can also get an inheritance from his father through a confession made by his father. All of these things must go through research first. Children of type 1 and 2 sirri marriage are entitled to inheritance from both parents according to Islamic law, while for types 3 and 4, only from the mother. An illegitimate child can inherit if his father acknowledges it. After isbat nikah, the child is entitled to inheritance from both parents, except for types 3 and 4, only from the mother.
