Abstract

PT. Rigunas Agri Utama has a partnership with Maju Farmers Gapoktan which consists of 170 heads of families with a total land area of 963 hectares. The partnership was formed with an authentic deed in the agreement Article 7 paragraph (1) The Purchase Price of FFB from the Second Party's garden refers to the prevailing price. However, the purchase of Fresh Fruit Bunches (FFB) from the Gapoktan Farmer Maju plantation by PT. Rigunas Agri Utama does not refer to the prevailing market price, thereby reducing payments for the sale of FFB by 5-8% per kilogram. This burdened the Maju Farmers Gapoktan, The main problem in this research is how to regulate the rights and obligations in the plasma nucleus oil palm plantation partnership between PT Rigunas Agri Utama and the Maju Farmers Gapoktan in Indragiri Hulu Regency, How is the implementation of the plasma nucleus oil palm partnership partnership agreement between PT Rigunas Agri Utama and the Farmers Gapoktan Maju in Indragiri Hulu Regency and How is the legal protection of Maju Farmers Gapoktan in implementing the agreement on the partnership pattern of plasma nucleus oil palm plantations in Indragiri Hulu Regency This type of research method and the nature of the research is sociological using legal materials which consist of primary data, namely data obtained directly from sources in the field and secondary data, namely data obtained from library materials. This research was conducted in this study the authors obtained from the Board of Directors of PT Rigunas Agri Utama, Treasurer of Maju Farmers Gapoktan, and Members of Maju Farmers Gapoktan. First, the partnership between PT Rigunas Agri Utama and Gapoktan Farmers Maju has been regulated in a transparent and fair manner by taking into account the rights and obligations of each party in the management of plasma nucleus oil palm plantations. Second, PT Rigunas Agri Utama does not fulfill its obligations under the partnership agreement, they can be deemed to have breached the contract and are threatened with legal consequences in the form of a civil lawsuit which can result in financial and reputational losses for the company. Therefore, it is important for PT Rigunas Agri Utama to comply with the obligations in the partnership agreement and resolve the discrepancy in the purchase price of the FFB with Gapoktan Farmer Maju to avoid unwanted legal consequences. Third, the partnership pattern agreement has not provided adequate legal protection to Gapoktan Farmers Maju because the majority of farmer members of Gapoktan Farmers Maju do not agree that they have received legal protection in implementing the agreement. Therefore, there needs to be an effort to improve legal protection in the partnership agreement.
