Abstract

A cooperation agreement is a contract that regulates the collaborative relationship between two parties, outlining their obligations, rights, responsibilities, and other legal aspects that bind the parties during the cooperation period.This cooperation agreement ensures that the management of oil palm plantations in Riau Province is carried out in accordance with applicable laws and regulations, aimed at implementing the "JAGA ZAPIN" program, particularly in addressing various legal issues related to investment, licensing, and economic activities in the agricultural sector and the processing of fresh fruit bunches (FFB) into Crude Palm Oil (CPO), while also preventing deviations that harm the state and society. It further aims to support an investment climate that promotes economic growth in Riau Province. The main issue in this research is how the legal power of the parties involved in the cooperation agreement between the Riau Provincial Plantation Service and the Riau High Prosecutor's Office regarding the implementation of the "Jaga Zapin" program can be examined under the Ministry of Agriculture Regulation No. 1 of 2018. Additionally, this research aims to explore the role of the Riau High Prosecutor’s Office in protecting the implementation of the "Jaga Zapin" program as seen from the perspective of the same regulation. This is particularly important in the context of Palm Oil Mills (PKS) that harm palm oil farmers by setting the price of Fresh Fruit Bunches (TBS) far below the price determined by the Riau Provincial Plantation Service. This Final Project uses observational research methods aimed at observing and describing the phenomena that occur. The data used consists of primary data from interviews and secondary data from laws, books, journals, articles, and research literature. The result of the author's research is that the legal strength of the parties in the cooperation agreement between the Riau Provincial Plantation Office and the Riau High Prosecutor's Office regarding the implementation of the Jaga Zapin program, as reviewed from the Minister of Agriculture Regulation No. 1 of 2018, has not yet fully and clearly regulated all provisions in an efficient manner, which disadvantages palm oil farmers concerning the price of fresh fruit bunches. Furthermore, the establishment of the cooperation agreement between the Riau Provincial Plantation Office and the Riau High Prosecutor's Office can provide legal assistance to the disadvantaged parties. The role of the Riau High Prosecutor's Office in protecting the implementation of the Jaga Zapin program has not been optimal in prioritizing transformative law enforcement based on local values, particularly for farmers and plantation workers in Riau Province.
