Abstract

The Love Scamming case also occurred in 2024, where the Directorate of General Crimes (Dittipidum) of the Criminal Investigation Branch of the National Police dismantled a fraud case with the love scamming mode through an online dating application. The National Police through the Directorate of Criminal Investigation of the National Police, Brigadier General Djuhandhani Rahardjo Puro, in a press conference announced that it had arrested as many as 21 (twenty-one) perpetrators of Love Scamming. The National Police has secured the perpetrators consisting of 19 Indonesian citizens, consisting of 16 men and 3 women. As well as 2 (two) male foreign citizens. Based on the results of the investigation, Bareskrim found one Indonesian citizen and 367 foreigners who were victims of love scamming fraud. In the thesis entitled "Policy for the Formulation of Law Number 1 of 2024 concerning Information and Electronic Transactions in Cyber Love Scamming Crimes", it is discussed in the problem, namely: Policy for the Formulation of Law Number 1 of 2024 concerning Information and Electronic Transactions in Cyber Love Scamming Crimes and Criminal Law Reform in Law Enforcement in the Era of Cyber-Based Crime. The method used to answer the problems mentioned above is the Normative Legal research method. Meanwhile, judging from its nature, this research is descriptive analytical. Data is obtained through literature studies such as books, journals, theses, papers, proceedings, and laws and regulations. The results of the study show that Indonesian laws and regulations do not specifically regulate the crime of love scamming, although law enforcement efforts against the crime of love scamming can still be carried out based on the provisions of the Criminal Code and the ITE Law and its amendments. The formulation policy of Law Number 1 of 2024 concerning Information and Electronic Transactions in Cyber Love Scamming Crime is the legal basis applied by the government to all forms of cybercrime, one of which is the crime of love scamming. This is because the crime of love scamming itself is basically an electronic-based crime in the form of fraud and/or unlawful acts by deceiving the victim by providing false information about himself to the victim with the aim of persuading the victim to give his property to the perpetrator. Criminal law reform is part of social policy which is essentially part of efforts to overcome social problems to achieve community welfare/protection, besides that criminal law reform is essentially part of efforts to support the smooth/effective law enforcement. Regarding the amendment of Law Number 11 of 2008 concerning Information and Electronic Transactions to Law Number 1 of 2024 is based on efforts to strengthen the guarantee of recognition and respect for the rights and freedoms of others.
