Abstract

Savings and Loan Cooperatives play a crucial role in helping their members obtain loans under more lenient terms compared to other financial institutions. However, in practice, breaches of contract or defaults on loan agreements often occur. These breaches may include late payments or the inability of members to repay their loans, which can impact the financial stability of the cooperative. Therefore, it is essential to examine the types of breaches that occur and the resolution mechanisms employed. This study aims to identify the forms of breach of contract in loan agreements between members and KSP Makmur Mandiri, Perawang Branch, Siak Regency, and analyze the settlement mechanisms applied by the cooperative. The primary focus of this research is how the cooperative handles members who default on their loans and the effectiveness of the resolution methods implemented. The research employs an empirical juridical method with a qualitative approach. Data were collected through direct interviews with cooperative management and defaulting members, as well as document studies related to loan agreements. The findings reveal that the most common form of breach of contract is late installment payments. The primary causes of default include economic factors, member negligence, and a lack of understanding of the loan agreement terms. Resolution efforts involve notifications and renegotiations. While the resolution mechanisms align with legal regulations, their effectiveness needs improvement through better member education to reduce the default rate.
