Abstract

The policy of determining minimum wages within the framework of wage protection currently still faces many obstacles as a result of the lack of a diversity of wages, apart from that there are still differences based on the level of ability, nature and type of work in each company where the conditions are different. – different, one of which is in the field of outsourcing. The outsourcing system is a reasonable business policy of a company in the context of business efficiency. Outsourcing arrangements according to labor law in Indonesia are regulated in Article 64 of Law Number 13 of 2003 concerning Employment. However, workers who carry out work in outsourcing companies must not lose their constitutionally protected rights. The implementation of outsourcing, several years after the issuance of Law Number 13 of 2003 concerning Manpower, still experiences various weaknesses, mainly due to the lack of regulations issued by the Government as well as injustice in the implementation of work relations between employers and workers. The problem formulation in this research is how to legally protect the wages of outsourced workers at PT. Sapta Adeka Sejahtera in Pekanbaru City and what are the obstacles in legal protection for the wages of outsourcing workers at PT. Sapta Adeka Sejahtera in Pekanbaru City. The research method used in this research is observation research using a survey, while the nature of this research is descriptive. The population in this study used a Quota Sampling sampling technique and the data collection tool used was interviews. The research results concluded that the research results showed a form of legal protection for outsourced security workers at PT. Sapta Adeka Sejahtera is not only limited to providing wages, but also protects workers' rights such as workers' participation in the BPJS program, Occupational Safety and Health Protection, and which are factors that become obstacles in legal protection for workers (security) at PT. Sapta Adeka Sejahtera, in terms of its wage system, is not running optimally, this is shown by two indicators, namely the lack of awareness on the part of the company or employer and the absence of complaints or reports from workers or workers.
