Abstract
An employment agreement is a legal bond that regulates the relationship between workers and the Foundation based on a mutual agreement that has been approved by both parties, in accordance with the provisions contained in Law Number 13 of 2003 concerning Employment. In practice, the Foundation generally uses two types of work agreements, namely a Certain Time Work Agreement (PKWT) and an Indefinite Time Work Agreement (PKWTT). At the ITTR Yuliyun Foundation, there was a case of violation of the PKWT agreement by a worker before the agreement ended. This is a problem that requires resolution in accordance with applicable regulations. The problem formulation in this author's research is: First, what is the legal protection for workers who resign before the end of the PKWT. Second, what is the legal settlement mechanism for workers who resign before the end of the PKWT. The research carried out by the author is empirical research because the author obtained data based on the research results. The nature of the research carried out by the author is descriptive, namely research that describes in detail the legal protection for workers who resign before the end of the PKWT. The author uses data collection to collect data with data instruments obtained from interviews, observations and library books. In drawing conclusions, the author uses a deductive method by taking a problem from the specific to the general. Legal protection for workers who resign before the end of the Specific Time Work Agreement (PKWT) at the ITTR Yuliyun Foundation cannot be fully provided because the worker does not provide a clear reason, as regulated in Article 61 of Law no. 13 of 2003 concerning Employment. The settlement mechanism carried out by the ITTR Yuliyun Foundation involves a deliberation process between workers and the Foundation. This deliberation includes direct consultation to reach a mutual agreement. However, if an agreement cannot be reached, the case will be resolved through litigation in accordance with applicable legal procedures.
