Abstract

a vendor is an entity, either an individual or an organization, whose role is to provide goods or services by selling them to companies or consumers. while outsourcing is the handing over of part of the implementation of work by one company to another company which is carried out with a written agreement. To provide a legal basis for every citizen in carrying out activities in the field of employment, the government issued law number 13 of 2003 concerning employment. Law Number 13 concerning employment is a law which is the basis for national development based on Pancasila and the 1945 constitution. The formulation of the research problem for this thesis is: First, what are the legal responsibilities of outsourcing vendors in managing the personal data of outsourced workers at PT.POJ based on Law Number 6 of 2023 concerning Job Creation and secondly, what are the obstacles faced by PT.POJ in The legal responsibility of outsourcing vendors in managing the personal data of outsourced workers is based on Law Number 6 of 2023 concerning Job Creation. This research uses empirical legal research methods and this type of research uses a qualitative descriptive approach. Data was obtained through interviews and literature study, then analyzed qualitatively. Secondary data was obtained from literature studies of relevant laws and regulations, literature and company documents. The method for drawing conclusions is deductive, that is, it is taken from general things to specific things. The results of the research that the author found are: First, the legal responsibility of outsourcing vendors in managing the personal data of outsourced workers at PT. outsourcing vendor in managing the personal data of outsourced workers in accordance with the mandate of Law Number 6 of 2023 concerning Job Creation, PT. POJ has implemented quite comprehensive personal data protection measures, such as obtaining consent from the data owner, implementing data processing principles However, there are still several areas that need to be improved, especially regarding the application of the principle of minimizing data and securing personal data. PT. POJ faces various internal obstacles, including a lack of awareness and understanding of personal data protection, weaknesses in governance and data security systems, as well as limited IT infrastructure. Second, the obstacles faced by PT. POJ in the legal responsibility of outsourcing vendors in managing personal data of outsourced workers based on law number 6 of 2023 concerning job creation are external obstacles including regulatory weaknesses and legal uncertainty, as well as escalation of cyber threats.
