Abstract

In order to improve the quality of Indonesia's productive and competitive workforce, it is necessary to develop employment policies that protect the rights and welfare of workers/laborers, both during work and after the end of the employment relationship. Regulations are needed that are adaptively able to respond to the challenges and dynamics of employment, especially regarding strategic issues regarding the protection of workers/laborers, including workers/laborers who are employed during overtime work. The main problem in this research is what the company's responsibilities are in providing overtime wages according to Government Regulation Number 35 of 2021 concerning Specific Time Work Agreements, Outsourcing, Working Time and Rest Time and Termination of Employment Relations, and what factors cause companies not to pay work wages. overtime for employees. The type of research used includes sociological legal research. Sociological legal research is research that looks at legal realities in society, looking at legal aspects and social interactions in society. Meanwhile, judging from its nature, this research is descriptive in nature. The company's responsibility in providing overtime wages according to Government Regulation Number 35 of 2021 concerning Specific Time Work Agreements, Outsourcing, Working Time and Rest Time and Termination of Employment Relations has not gone well. This is as PT. Riau Emperor Utama pays overtime wages but it is not in accordance with and/or contrary to Government Regulation Number 35 of 2021. PT. Kampar Jaya and PT. Bintang Gunung Sari has never provided overtime pay to employees. The factors that cause companies not to pay overtime wages to employees include; (i) unstable Company finances; and (ii) the Company's lack of knowledge of applicable regulations.
