Abstract

In the context of regulation, the trade of Tuamang nets that violates the law contradicts Law No. 31 of 2004 on Fisheries, as amended by Law No. 45 of 2009. Article 84 of the law prohibits the trade of fishing gear that damages the environment. In this case, the trade of Tuamang nets that does not comply with legal provisions constitutes a violation of this regulation and can be subject to severe penalties. Enforcing the law against such violations is essential to maintaining compliance with regulations and protecting marine ecosystems and the local economy. The research problem in this study is how the trade of Tuamang nets operates in Panipahan Village, Pasir Limau Kapas District, Rokan Hilir Regency, and how the illegal trade of Tuamang nets occurs in the same area. The research method used combines empirical and normative legal approaches. Empirical legal research focuses on collecting data from real-life situations in the field, particularly regarding the implementation of the law in Panipahan Village. The study aims to understand how legal practices are carried out and the obstacles encountered. The legal materials collected are then analyzed, examined, and categorized into specific sections to be processed into information. The results of the analysis are interpreted using systematic and grammatical interpretation methods. The findings of the research reveal that many fishermen continue to use Tuamang nets to meet their economic needs despite being aware of their negative impacts. This indicates the need for increased education, alternative legal fishing gear, and more intensive monitoring by relevant parties to protect ecosystems and ensure legal compliance. From a business law perspective, the sale and use of Tuamang nets in Panipahan Village reflect a dilemma between economic benefits and social responsibility toward environmental sustainability. This practice not only risks violating regulations but also raises ethical and environmental concerns that conflict with the principles of business ethics and the theories of consumer and environmental protection.
