Abstract
ABSTRACT The Social Security Administering (BPJS) brings a lot of hope to the community, especially health insurance. RSUD Arifin Achmad Pekanbaru is a government hospital which is also the main referral hospital in Riau Province, including for patients using BPJS. As the main referral hospital, it is hoped that it can become a forum for optimal health services to the community. Service quality plays an important role in realizing patient satisfaction in accordance with what patients expect. However, in reality, patients are still dissatisfied with the services provided by hospitals, especially to BPJS participating patients, this gives rise to views that should not happen. The author wants to discuss the problem formulation as follows: 1) What is the legal protection for BPJS health patients regarding health services for BPJS Health patients at Arifin Achmad Hospital Pekanbaru, 2) What legal efforts can BPJS participant patients take if the health services are provided by Arifin Achmad Regional Hospital? Pekanbaru does not fulfill patient rights. In this research, the author uses empirical or sociological legal research methods, namely research by obtaining data from primary data sources by directly observing conditions in the field. This research is also descriptive research, namely it will be presented in the form of a systematic explanation. The research results show that in Indonesia, the government implements several regulations which are the basis for efforts to protect patients in providing their rights to health insurance. Regulation of the Minister of Health of the Republic of Indonesia Number 28 of 2014 concerning Guidelines for Implementing the National Health Insurance Program, the Health Law, the Hospital Law, as well as the Consumer Protection Law are the basis for the government's protection efforts for patients, especially BPJS participants. Arifin Achmad Regional Hospital has a complaints unit which functions as a forum for patients to convey complaints they have experienced as part of the hospital's efforts to realize patient rights. If a problem occurs and is not resolved through mediation with the hospital, the patient can file a legal remedy for litigation in court.
