Abstract
ABSTRACT In this life, insurance practices do not always work well, as evidenced by the problems that often occur, especially the insured who does not inform the Insurer honestly about the object or event, resulting in claims being rejected. Law Number 40 of 2014 concerning Insurance clearly states that the insurer must bind itself to the Insured through the provisions stated in the Policy. The policy is proof of the existence of an insurance agreement. The main problem in this research is how to apply the principle of utmost good faith in motor vehicle insurance at PT, Sompo Insurance, Pekanbaru Branch and what are the obstacles in implementing the principle of utmost good faith in motor vehicle insurance at PT. Sompo Insurance, Pekanbaru branch. This research uses an empirical legal method, namely a data collection method by studying facts in the field sourced from primary data. Meanwhile, the nature of the research is descriptive analysis. The results of the thesis research that the author found were that the implementation of the Principle of Utmost Good Faith in motor vehicle insurance at PT. Sompo Insurance Pekanbaru Branch is to collect honest information from the insured which can affect insurance risks, as well as the insurance company providing information regarding policies, limits and claim procedures and conducting field surveys to ensure clarity of events. The obstacles in implementing the Principle of Utmost Good Faith for motor vehicle insurance at PT. Sompo Insurance are the dishonesty of the insured who does not provide correct information when submitting claims, difficulty in understanding the language or provisions in the insurance policy by the Insured and the Insured is often careless. in carrying out activities so that it can increase the risk object because the object has been insured by the insured.
