Abstract

The dispensation given for marriage is even though it is useful for "if you are married, there are concerns that it will have a negative impact on both the mother and the child being born, another negative impact is that women's reproductive health will be disturbed, from a social perspective, early marriage can reduce family harmony, this is caused by emotions. who is still unstable, has young blood and an immature way of thinking. Looking at early marriage from various aspects does have many negative impacts The formulation of the problem in the research is: What are the legal consequences of underage marriage according to Law Number 16 of 2019 concerning marriage in the Pekanbaru City Religious Court and what are the problems of underage marriage in the Pekanbaru City Religious Court? type of research is included in the Juridical-Empirical Law research method, namely legal research related to the normative application of laws in every society's life, in this case looking at the implementation of marriages of minors according to Law Number 16 of 2019 concerning Marriage. There are three legal consequences that will arise if the child receives marriage dispensation, namely: The child will lose his or her rights which are protected by the Child Protection Law. Children are considered legally competent people even if they are not yet 21 years old. Children are allowed to enter into marriage. Parental control over children will be lost. If the dispensation for marriage continues to be issued then automatically many children will marry underage and Indonesia's education rate will continue to fall, the population growth rate will increase and in the next four or five years it is feared that the divorce rate will be even higher. However, if marriage dispensation is not given for children under this age, on average those who apply for dispensation are those who have become pregnant out of wedlock or those who have avoided adultery.
