Abstract
ABSTRACT The implementation of buying and selling land without a certificate is one of the problems that often occurs in society, namely the implementation of buying and selling land without a certificate. In fact, a land certificate is a valid and strong proof of land ownership. The aim of this research is to find out how the practice of buying and selling uncertified land is and what the legal consequences are according to Government Regulation Number 24 of 1997 concerning Land Protection. Transferring ownership rights to land by buying and selling will be difficult if the seller does not have a certificate for the plot of land he or she is selling. In connection with this, the author conducted research with a problem formulation related to how the sale and purchase of land that does not have a certificate is carried out in Sekapas Village, Rantau Kopar District, Rokan Hilir Regency and what are the legal consequences of buying and selling land that does not have a certificate in Sekapas Village, Rantau Kopar District , Rokan Hilir Regency. The method used is Sociology or Empirical which is carried out by survey, namely the author goes directly to the field by conducting direct interviews with village government officials and members of the Sekapas village community, Rantau Kopar District, Rokan Hilir Regency. Meanwhile, the nature of this research is descriptive where the author tries to provide a detailed description of the implementation of buying and selling land that does not have a certificate in Sekapas Village, Rantau Kopar District, Rokan Hilir Regency. The results of this research are that the sale and purchase of land that is not certified still often occurs among the community, there are even some people who carry out transactions without being in the presence of an authorized public official, the form of community proof is only based on receipts, proof of receipts alone does not provide strong legal force, As a result of carrying out land buying and selling transactions without being in the presence of the competent authorities, it will make it difficult to prove if the land being bought and sold is defended, and will result in the absence of preservation of land rights or the absence of legal certainty and legal protection. The implementation of buying and selling land that does not have a certificate in Sekapas Village, Rantau Kopar District, Rokan Hilir Regency is seen from 2 aspects, namely the Implementation of buying and selling between communities and the Implementation of buying and selling land from village officials. As well as the legal consequences of implementing land sales and purchases between communities and land sales and purchases without the presence of village officials.
