Abstract

Semelinang Darat Village, Peranap District, Indragiri Hulu Regency, precisely in Pandan Wangi, is a village where buying and selling of palm oil often occurs between tokes (buyers) and the community, which has been going on for a long time. The sale and purchase between the toke (buyer) and the farmers is carried out by making an agreement regarding the price of palm oil at IDR 2,300 per kilogram. After the price is determined by the seller, the buyer is obliged to pay the entire price to the seller. In Article 1320 of the Civil Code, the validity of an agreement includes 4 conditions, including: There is an agreement, there is proficiency in the law, there are certain conditions, and there is a lawful cause. The formulation of the problem is how to implement the palm oil sale and purchase agreement between the palm oil toke and the Pandan Wangi community, Semelinang Darat Village, Peranap District, Indragiri Hulu Regency and how to resolve the default on palm oil sale and purchase between the palm oil toke and the Pandan Wangi community, Semelinang Darat Village, Peranap District, Indragiri Hulu Regency. And the objectives From this research, namely to find out the implementation of the palm oil sale and purchase agreement between the palm oil toke and the Pandan Wangi community, Semelinang Darat Village, Peranap District, Indragiri Hulu Regency and to find out how the default on palm oil sale and purchase between the palm oil toke and the Pandan Wangi community, Semelinang Darat Village, Peranap District Indragiri Hulu Regency. This research uses an empirical legal approach. This method is used to obtain the truth in discussing existing problems and to see the application of legal rules in society. The analysis was carried out descriptively which will describe and explain how the palm oil sale and purchase agreement was implemented between the palm oil company and the Pandan Wangi community, Semelinang Darat Village, Peranap District, Indragiri Hulu Regency. The implementation of the agreement made by the supplier (toke) with the Pandan Wangi community, Semelinang Darat Village, Peranap District, Indragiri Hulu Regency, is through a face-to-face process and for the validity of the agreement by shaking hands. The settlement of the palm oil sale and purchase agreement between the palm oil toke and the community in Pandan Wangi which experienced a default, this problem is still in the negotiation stage between the Pandan Wangi community (farmers) and the toke owner. We hope that the toke owners will carry out the agreement in accordance with the agreement agreed at the beginning with the Pandan Wangi community.
