Abstract

ABSTRACT Based on the prevailing regulations, the Right of Land Management (HPL) governing land management also serves as an indicator to assess the state's authority in land ownership. Article 2 Paragraph 2 of the Basic Agrarian Law (UUPA) of 1960 asserts that the state's right over land encompasses all aspects, including land, water, airspace, and natural resources within it, deemed as part of the national wealth with an inseparable relationship with the Indonesian nation. This study evaluates the compatibility of land management rights over Pulau Rempang regulated by the government with the legal basis according to Presidential Decree Number 41 of 1973 concerning Industrial Area Management in Pulau Batam. Furthermore, this research also assesses whether the management and relocation conducted comply with the provisions of the Basic Agrarian Law. This study falls into the category of literature research with a juridical-normative approach, which examines issues based on legal foundations. The findings of this research indicate that Presidential Decree Number 41 of 1973 designates Pulau Batam as an industrial area workplace supported by the Industrial Area Development Authority of Pulau Batam. The Batam Authority grants permission to third parties to manage land on Pulau Rempang by paying fees determined by the Batam City Government. Pulau Rempang has been designated as a Bonded Zone. Conflict between authorities and the community arises due to the Rempang Eco City Project in 2023. The community opposes relocation on Pulau Rempang as it is customary land and has been occupied by the community for 20 years. This is intended to ensure that the customary land rights of the Pulau Rempang community are recognized as physical landowners protected and acknowledged by the government. Keywords:
