Abstract

ABSTRACT The background of this research is that companies that own palm oil mills enter into sale-purchase agreements of fresh palm fruit bunches with suppliers to provide certainty that later the suppliers will send quality fresh fruit bunches of palm oil. Oil palm fruit or also known as fresh fruit bunches (FFB) is the result of the production of oil palm agriculture, then the oil palm fruit is processed into Crude Palm Oil (hereinafter abbreviated as CPO), in which the results of the processed CPO have great benefits besides being useful for sustainability people's daily lives as well as the continuity of the economy in Indonesia. The formulation of the problem from this research is how the implementation of the work agreement for the financing of the sale and purchase of palm oil FFB between the FFB Supplier and PT. Daria Dharma Pratama ? and what are the obstacles in implementing the work agreement for the sale and purchase of palm oil FFB at PT. Daria Dharma Pratama? In terms of its type, this research belongs to the type of sociological research, which is carried out by way of the writer going directly to the field to collect data, namely in the form of direct interviews with the parties involved in this research. While seen from the nature of this research is descriptive, which means it provides a clear picture of the main problem of research. The results of the study are the implementation of the oil palm fruit sale and purchase agreement between the supplier and PT. Daria Dharma Pratama, in carrying out the agreement in writing or underhand not being registered with the authorized official, in carrying out the sale and purchase agreement of the palm fruit is initiated by the supplier coming and offering fresh palm fruit bunches to the buyer. In the implementation of the agreement there was an act of default committed by the seller, namely the supplier with PT. Daria Dharma Pratama. Obstacles that occurred in the implementation of the sale and purchase agreement for oil palm FFB were defaults made by the supplier to PT. Daria Dharma Pratama, the principle of freedom of contract in the sale and purchase agreement of fresh fruit bunches (FFB) between suppliers and PT. Daria Dharma Pratama that the implementation of the agreement was carried out in writing and under the hand it was not registered with the authorized official as well as natural factors such as failure or delay in carrying out the transportation of FFB to PT.
