Abstract

Marriage is a way chosen by God to maintain the continuity of human life on earth with the aim of maintaining the honor and dignity of human glory. However, along with the dynamics of social life, marriage problems become complex, even in the midst of society, there are pro and con opinions regarding interfaith marriages. The aim of this research is to find out the meaning of marriage and the legality of interfaith marriages in Indonesia in terms of Islamic law as well as the approach of civil law in Indonesia towards interfaith marriages in Indonesia. This research uses normative legal methods, which is a type of research in the library research and literature study category by collecting data from various literature related to research material. The results of the research explain that the view of Islamic law on interfaith marriages is in principle not permitted because it is stated in the Al-Qur'an that marriage between Muslims and polytheists is expressly prohibited as written in Surah Al-Baqarah. And the provisions of Indonesian civil law do not expressly prohibit interfaith marriages. However, from the existing provisions and Indonesia's position as a non-secular country, it is interpreted that in Indonesia interfaith marriages cannot be held and if they occur, this is a violation of the constitution.
