Abstract

Palm oil theft in Kampar District in 2017-2021 there were 24 cases involving children as perpetrators. The case of theft is a criminal act which is an unlawful act and can be prosecuted by law. Thus, the research objective was set to find out the application of Restorative Justice to the theft of palm fruit by children in the jurisdiction of the Tapung Hulu Police Station. The restorative justice approach is different from the conventional criminal justice system, the main point of this approach is the direct participation of perpetrators, victims and the public in the process of resolving criminal cases. This research uses a qualitative approach with a case study method. Research data comes from primary data and secondary data. The results of the study concluded that the mechanism for implementing restorative justice involves many parties to deliberation and reach an agreement. In the deliberation the parties were present to agree to make a peace letter and make a statement withdrawing the report. The parties present were the perpetrator, the victim (reporter), the parents of the perpetrator, village officials (head of the hamlet and head of the RW) where the crime occurred. Then a peace agreement letter is submitted to the police for the withdrawal or revocation of the report that has been reported by the victim. The application of restorative justice in cases of theft of oil palm fruit by minors has fulfilled all the criteria, so that the application of restorative justice is a wise decision to be taken by law enforcement.
