Abstract
In Pekanbaru City, many online transportation drivers complain about unilateral cancellation of orders made by consumers. The unilateral cancellation is contained in various service features in the online ojek application. Such as unilateral cancellation in food orders which in Go-Jek's online ojek application feature is called "Go-Food". Many drivers said they were surprised and complained when food was ready to be delivered and rushed to open the ride-hailing app on their smartphones to see where they were going to be delivered, but there were messages from consumers cancelling orders unilaterally. The driver tried to contact the consumer, but the driver's number was blocked. In addition, consumers provide addresses that do not correspond to actual circumstances. So that the driver cannot deliver the order to the consumer's address. In the thesis entitled "Legal Protection for Online Transportation Drivers Due to Unilateral Cancellation by Consumers (Study in Pekanbaru City)" it discusses the problems, namely: What is the form of Legal Protection for Online Transportation Drivers Due to Unilateral Cancellation by Consumers in Pekanbaru City and What are the legal consequences of Unilateral Cancellation by Consumers on Online Transportation Drivers in Pekanbaru City. The method used to answer the problems mentioned above is empirical research with the nature of analytical descriptive research. Primary data obtained through interviews, questionnaires and direct observation to respondents or samples. Secondary data are obtained from literature books that support the subject matter discussed and laws and regulations. The results of the study show that there is no form of legal protection received by drivers for unilateral cancellation by consumers both in the Civil Code and in Law Number 8 of 1999 concerning Consumer Protection. The results of interviews and drivers' answers on the questionnaire sheet found that many drivers did not get compensation in nominal money. This compensation is one of the rights that must be received by drivers. Legal consequences for debtors who have defaulted are penalties or legal sanctions, one of which is contained in Article 1243 of the Civil Code. However, in this case the consumer does not receive any legal consequences for his actions that have made unilateral cancellations because in reality, the consumer cuts off communication or blocks access to communication with the driver, so that he does not receive the legal consequences he should receive, where he as the adverse party is obliged to compensate for the losses suffered by the driver.
