Abstract

This study discusses the application of restorative justice to cases of minor accidents in the jurisdiction of the Mandau Police. The choice of this title was motivated by the mechanism of settlement of cases of minor accidents, whereby the settlement of restorative justice in cases of minor accidents is very fair to the victims and to the perpetrators. In practice, it can be seen that a number of traffic accident cases were resolved peacefully between the parties. This study aims to find out how restorative justice is applied to traffic accident cases that result in minor injuries in the jurisdiction of the Mandau Police. This type of research is sociological legal research, namely research by survey method. The type of data used in this research comes from primary data and secondary data. Primary data is obtained from field research results while secondary data is obtained from library research results. The nature of this research is descriptive, namely Head of Bengkalis Police Headquarters, Bengkalis Police Head of Legal Unit, Actors, Victims, Traffic Police, data analysis used in this study is qualitative data analysis. From the results that the authors get, the application of restorative justice is resolved in a familial way by implementing ADR (Alternative Dispute Resolution) by involving parties starting from the perpetrators, victims, Mediators, Head of Traffic Traffic. The agreement obtained from the results of peace is set forth in a peace agreement signed by the parties in resolving it by Alternative Dispute Resolution, while the obstacle to implementing restorative justice is the difficulty of reaching an agreement between the perpetrator and the victim during the peace process.
