Abstract

The development of the business world is currently experiencing very rapid growth in various fields, including Indonesian positive law (ius constitutum) which regulates the form of Limited Liability Companies. With the passing of Law Number 6 of 2023 concerning Job Creation, a new type of PT has been created, namely the company. that meets the standards for micro and small businesses known as Individual Companies. Considering the strategic nature of this new legal entity, it is important to study it, especially what the legal concept of an Individual Company is, what the responsibilities of the company and its management are, and what happens in the event of bankruptcy. The main problem in this research is to examine what factors can cause an Individual Company to become Bankrupt as well as what the legal responsibilities of directors are and the legal consequences of Individual Company bankruptcy according to Law Number 6 of 2023 concerning Job Creation. This type of research is normative juridical using a statutory approach and a conceptual approach. The results of this research are the Form of Legal Responsibility of Directors of Bankrupt Individual Companies According to Law Number 6 of 2023 concerning Job Creation, namely, directors must be personally responsible for the bankruptcy of the company, when they have been proven wrong or negligent in carrying out their duties, otherwise if the directors can prove that as long as the company is run in good faith and full of responsibility, it will be free from all forms of personal responsibility for the company's bankruptcy.
