Abstract

In general, in principle, marriage adheres to the principle of monogamy, both in positive law and based on Islamic law. Article 3 paragraph (1) of Law Number 1 of 1974 Concerning Marriage says, "in principle in a marriage a man can only have one wife, a woman can only have one husband, but in reality the practice of polygamy for various reasons is still happens very often. Terminologically, polygamy can be understood as a situation in which a husband has more than one wife. More concretely, the problem of this research is what will be considered by the panel of judges in the religious court if they give permission for polygamy and how to analyze the legal reasoning of judges in granting permission for polygamy in decision number 192/Pdt.G/2022 /PA. Pbr. The type of research used in this study is included in the category of Observational Research (empirical). In which there are two types of data collection, namely primary data and secondary data. The purpose of this research is to find out what the panel of judges will consider when giving permission for polygamy and to find out the analysis of the legal reasoning of judges in granting permission for polygamy in decision number 192/Pdt.G/2022/PA.Pbr In deciding a polygamy case, the panel of judges at the Pekanaru Religious Court usually in their legal considerations refers to the conditions for the permissibility of polygamy regulated in Law Number 1 of 1974 concerning Marriage and KHI (Compilation of Islamic Law).
