Abstract

An accident is an event experienced by humans that results in material loss or loss of life. This can happen to humans anywhere and anytime. The main problem in this research is how is the accountability for criminal acts for traffic accidents that cause other people to die (Case Study Case Number: 239/PID.SUS/2022/PN Plw and what are the judge's considerations in deciding a traffic accident that causes Another Person Died (Case Study Case Number: 239/PID.SUS/2022/PN Plw. This research is classified as normative legal research. Normative legal research is a scientific research procedure to find the truth based on legal scientific logic from a normative perspective, namely research conducted by analyzing library materials or document materials. Based on the results of the research conducted by the author, the results obtained are the form of accountability for the crime of traffic accidents that result in other people based on Law Number 22 of 2009, with the elements of the crime of traffic accidents accompanied by witness statements and the defendant connected with the evidence, the defendant has been proven to have committed a crime and is responsible for his treatment in the decision of the Panel of Judges in decision Number: 239/PID.SUS/2022/PNPlw, and the Judge has decided "Send a sentence to the Defendant therefore with imprisonment for 1 (one) year, and a fine of Rp. 5,000,000.00 (five million Rupiah), provided that if the fine is not paid by the Defendant, it will be replaced by imprisonment for 2 (two) months."
