Abstract

The ever-increasing needs and desire to develop for a better life require every individual to want to develop and try as much as possible to support their family. In article 1311 of the Civil Code, it is explained that an agreement is one or more people binding themselves to one or more other people. This savings and loan activity is of interest to the people of Terantang Manuk Village. So the focus of this research is the Savings and Loans Activity Agreement between Bumdes Terantang Jaya and the Community. In its implementation, the Terantang Jaya Village-Owned Enterprise carries out a type of business in microfinance services in the form of providing savings and loan credit. This savings and loan activity ran smoothly, but as time went by there were several people who were in arrears on installments to BUM Desa Terantanah Jaya. The main issue is how to implement the agreement between Bumdes Terantang Jaya and the people of Terantang Manuk Village who carry out savings and loan activities, and what obstacles are faced in implementing the agreement. The research method used in this research is included in the category of empirical legal research/sociological legal research. Meanwhile, judging from its nature, it is descriptive analytical. From the results of this research, it can be concluded that the implementation of the agreement between Bumdes Terantang Jaya and the Community is still not running, with the contents of the agreement where there are still customers who are late in payments, and the sanctions that should be carried out have not been implemented explicitly. The sanctions sought by the Bumdes in accordance with the agreement are not carried out properly so that the community still does not have a high level of awareness regarding payments.
