Abstract

This study aims to determine the legal protection of consumers of traditional medicine in Pekanbaru and to find out the obstacles and efforts to overcome obstacles in the legal protection of consumers of traditional medicine in Pekanbaru. This study is a qualitative research conducted in Pekanbaru City with the research sample being the Head of the Pekanbaru City Health Office, the perpetrators of traditional shinse medicine and the community or consumers of traditional medicine. The formulation of the problems in this study are: (a) How is the legal protection for traditional medicine in Pekanbaru? (b) What are the obstacles and efforts to overcome obstacles in legal protection for consumers of traditional medicine in Pekanbaru? This type of research is classified as observational research, namely research that goes directly into the field by conducting interviews to obtain complete data. The nature of this research is descriptive, explaining in detail the legal protection of consumers of traditional medicine in Pekanbaru The results of the study show that legal protection in traditional medicine is stated in Article 1 number 16 of Law Number 36 of 2009, which as meant by traditional medicine is treatment and/or treatment with methods and drugs that refer to the experience and skills of hereditary which can be accounted for and applied. according to the norms prevailing in society. The obstacle in law enforcement is that if there is a deviation in the provision of health services, the patient can claim his rights that have been violated by the health service provider, in this case the health provider in the context of alternative/traditional medicine, then the alternative/traditional medicine service provider can be held legally responsible, if make omissions or mistakes that cause harm to the patient as a consumer.
