Abstract
KPR houses that have subsidies are not allowed to transfer ownership unless they have been occupied for more than 5 years. However, in reality, in the field of this problem, there are still related parties who do this and violate these provisions. So there is still a gap in the field with the regulations that regulate it because it has not provided effectiveness in enforcing the provisions governing over credit and there is still a lack of debtor responsibility for the credit that has been given to him. The main research problem is what is the Debtor's Responsibility in Take Over Credit for Subsidized Home Mortgages Based on Ministerial Regulation No. 26/PRT/M/2016 At Bela Berlian 3 Housing, Kampar Regency, and what are the legal consequences of Take Over Credit for Subsidized KPR Houses carried out by debtors Based on Ministerial Regulation No. 26/PRT/M/2016 At Bela Berlian 3 Housing, Kampar Regency. The research method is empirical legal research or sociological research, namely legal research that uses primary data. while its nature is descriptive, namely where the author describes in a clear and detailed manner the problem to be studied. The results of the research show that the Debtor's Responsibility for Take Over Credit for Subsidized KPR Homes is Based on Ministerial Regulation No. 26/PRT/M/2016 In Bela Berlian 3 Housing, Kampar Regency, the debtor did not fulfill the obligation because he had received an obligation from the bank to pay off the house but the debtor transferred it so that the debtor's actions were included in the criteria for default where the consumer did not do what he had agreed to do in the agreement. Home Ownership Credit (KPR) because when a consumer signs a Home Ownership Credit agreement with the bank, this means the consumer agrees or undertakes to pay monthly installments to the bank until the debtor completes the credit, and the legal consequences of Take Over Credit for Subsidized Home KPR made by the debtor Based on Ministerial Decree No. . 26/PRT/M/2016 In Bela Berlian 3 Housing, Kampar Regency, it is possible to revoke the KPR subsidy from the bank, however this subsidy has never been revoked by the bank for over-credit as long as the credit is not problematic, over-credit is done unofficially then This will result in uncertainty about home ownership, causing the credit payments made by the new debtor to not have legal force when a problem arises because the legal rights remain with the old debtor, not the debtor who received the transfer.
