Abstract
The phenomenon of the existence of buses that are not roadworthy is very detrimental to passengers both in terms of comfort and safety. Whereas in the Consumer Protection Law Number 8 of 1999 which states that passengers are entitled to comfort, safety and protection of the goods and / or services they own. In addition, Law No. 22 of 2009 concerning Road Traffic and Transportation also requires the fulfillment of service standards related to the safety and comfort of public transportation, but in reality it is different, on the other hand companies sometimes do not think about the obligations that must be fulfilled to passengers, related to whether the vehicle they own is roadworthy or not. The formulation of the problem in this study is How is the law on the operation of buses that are not fit to operate according to Law No. 8 of 1999 related to consumer protection at Jati terminal in Pariaman City and how the use of consumer protection for buses that are not roadworthy according to Law No. 8 of 1999 concerning consumer protection at Jati terminal in Pariaman City. This research method is the type and nature of the research is a case approach (Case Aprroach. Juridical-Empirical research uses legal materials consisting of primary data, namely data obtained directly from sources in the field and secondary data, namely data obtained from library materials which are divided into primary law material, secondary law material. This research was conducted by means of the author obtaining data from the relevant agencies and drawing conclusions using the inductive method, namely a statement that is specific so that it is general in nature. The results of this study are first, Law No. 8 of 1999 related to consumer protection at the Jati terminal in Pariaman City, each passenger will get an insurance program whose funds are collected from mandatory contributions that must be paid by the company to PT Jasa Raharja. The mandatory contribution is obtained from every passenger who buys a transportation ticket (bus). Second, how to use consumer protection, the Pariaman City Transportation Office commemorates or appeals to transportation companies so that their vehicles are brought to the testing office by bringing the appropriate inspection book (motor vehicle test book), then if the inspection book is not brought, the Pariaman City Transportation Office does not issue a route permit for the vehicle.
