Abstract
As time goes by, economic activities can be carried out via the internet, such as buying and selling activities. Pekanbaru Online Buying and Selling (PJBO) is one of the groups on Facebook as a forum for online buying and selling in Pekanbaru City. The description of the goods attached by the seller is a form of promise given to the buyer by the seller as regulated in the Information and Electronic Transactions Law, requiring sellers to provide complete and correct information relating to the products offered. In practice, many sellers are found who do not deliver goods according to the description, resulting in losses for buyers. The problems that will be discussed are: 1) How to implement online buying and selling of motorbike spare parts products via the Facebook marketplace in the PJBO group in Pekanbaru City. 2) What is the seller's responsibility for motorbike spare part products that do not match the description in online buying and selling via the Facebook marketplace in the PJBO group in Pekanbaru City. The author uses an observational legal research method, namely research that apart from looking at positive legal aspects also looks at practice in the field. The data collection method used was conducting interviews with respondents. The results of the research show that online buying and selling of motorbike spare parts products in the PJBO group in Pekanbaru City can be carried out by all Facebook users who are members of the group, but not all sellers pay attention to the transaction method as regulated in the ITE Law as a buyer's right. The seller's responsibility to the buyer for products that do not match the description in online buying and selling in the PJBO group. In practice, it is often found that sellers are not responsible for goods received by buyers that do not match the description, resulting in losses. Based on Article 19 UUPK, business actors are required to be responsible by providing compensation in the form of refunds or goods to consumers. However, there are still many sellers who do not want to take responsibility.
