Abstract

Land rights are fundamental human rights that are essential to a person's freedom, life and dignity. The state, however, is obliged to protect the rights of the entire state, even though these rights are inalienable, and is compelled to do so in the interests of other individuals, communities, and other states. Land conflicts cannot be avoided by anyone in this modern era. The existence of a fairly large plantation industry in the Bintan Regency area makes it vulnerable to disputes in the land sector. Land conflicts often occur between companies and communities, the government and communities, and communities themselves. The main problems contained in this thesis research are how to implement land dispute resolution through mediation at the Bintan Regency Land Office and what are the inhibiting factors in implementing land dispute resolution through mediation at the Bintan Regency Land Office. This research uses descriptive research methods with a qualitative approach. The data analysis method used in this research is inductive reasoning to reach findings through qualitative analysis. In the data analysis process, there are two types of document data used, namely: primary data by distributing questionnaires to those who are carrying out dispute resolution and conducting interviews with the head of the Bintan Regency Land Office and mediators related to disputes. The research results show that the implementation of dispute resolution through mediation at the Bintan Regency Land Office is carried out based on PM ATR/KBPN Number 21 of 2020, in its implementation there are still some rules that have not been implemented. For example, in carrying out mediation, the mediation process is carried out no later than thirty working days. However, in practice the mediation process takes more than thirty working days and mediation carried out 3 times tends to fail. In resolving land disputes through mediation, the Bintan Regency Land Office encountered several inhibiting factors, namely: (1) the parties to the dispute did not have the intention and deliberately did not follow the mediation procedures, (2) the low level of involvement of the conflicting parties in resolving land disputes , (3) requires additional human resources at the Bintan Regency Land Office, especially in the mediator department who are certified and have experience in handling mediation
