Abstract

Based on Article 19 paragraph 3 of Law Number 24 of 2011 concerning Social Security Administering Bodies, BPJS health participants have an obligation, namely that participants who are not workers and who are not recipients of Contribution Assistance are obliged to pay and deposit the Contributions that are their responsibility to BPJS. The congestion of contributions that other participants have to subscribe to will affect other participants, because if there are many contributions that are stuck, then the mobility of BPJS Health funds which uses the principle of mutual assistance. Delays in payments will result in contribution burdens which will affect the receipt of contributions at social security administering institutions, so that will have an impact on the collateral that will be received by the collateral participant. The problem formulation of this research is how is the settlement of outstanding contributions for BPJS Health participants in Pekanbaru City based on Law Number 24 of 2011 concerning the Social Security Administering Body? 2011 About the Social Security Administering Agency? The research method used in this research is this type of research which is included in the category of Empirical Legal research, namely research which aims to observe and describe the symptoms that occur in social phenomena, which occur at a certain time level. The results of the discussion from this research are that the settlement of outstanding contributions for BPJS Health Participants in Pekanbaru City based on Law Number 24 of 2011 concerning Social Security Administering Bodies has currently not yet found a bright spot, and has been implemented well even though the settlement carried out has prioritized the principles of justice. In practice, the new settlement can be realized if the participant has paid off all debts and arrears of participant contributions to BPJS, this is not the right settlement decision because unilaterally it still puts the participants in a disadvantaged position because they cannot sue his rights. and Inhibiting factors in the implementation of settlement of outstanding contributions for BPJS Health participants involve various aspects of regulations, rules and related legal rights and obligations. The following is a detailed explanation of these factors: Employment where participants who do not have a job will reduce their regularity in paying health contributions because they do not have income allocated to paying health contributions. And the factor of higher income or simply having more funds so that awareness of paying contributions becomes greater.
