Abstract

Cases of loss of goods and damage to goods received during the process of sending goods, including default or unlawful acts, can be seen from the provisions regarding compensation. Compensation for damages based on breach of contract is in accordance with the provisions of the previously agreed agreement. Meanwhile, for unlawful acts, compensation for these actions is handed over to the judge to assess the amount of compensation. The problem formulation in this research is. What is the form of responsibility of J&T Express Kaharuddin Nasution, Pekanbaru City for lost/damaged consumer goods and what are the factors that cause damage to goods and loss of consumer goods during delivery? The type of legal research method that the researcher uses in this thesis research is the empirical legal method, which in other words is sociological legal research where this research is carried out directly in the field. With the nature of the research, namely analytical descriptive, this method is used to see the legal reality that exists in society. The results of the research that the author found were that the Standard Operating Procedure for J&T Express delivery itself has provisions regarding responsibility for losses experienced by the sender after using the J&T Express goods delivery service. Responsibility for compensation can be provided through guarantees given to transportation service users in "Material guarantees include compensation for movable and immovable objects, and immaterial guarantees include non-material guarantees or compensation in the form of money". According to Article 19 of Law No. 8 of 1999 concerning Consumer Protection. Every business actor must be responsible for the goods and/or services provided to consumers. However, in reality, not all consumer rights can be compensated by the Expedition. And the delay or loss is due to several factors, namely: Obstacles during the journey, negligent expedition employees, problems in the warehouse (package build-up), incorrect data, dense number of consumers, mixed up or wrongly sent packages.
